This Privacy Policy applies to Kolbe & Kolbe Millwork Co., Inc., and our subsidiaries, Kolbe Galleries, Inc. and Kolbe ServicePro, Inc. (collectively, “Kolbe,” “we,” “our,” or “us”). Kolbe sells its high-quality doors and windows through a network of authorized distributors. Kolbe also sells some parts and services directly to consumers. Kolbe operates publicly available websites at kolbewindows.com, kolbegallerytwincities.com and kolbeservicepro.com (“Sites”) where individuals and entities may obtain more information about Kolbe’s products and services (“Services”).

Some of the information Kolbe collects is considered “personally identifiable information", “personal information” or “personal data” under applicable law (collectively referred to in this Privacy Policy as “Personal Information”). Generally, Personal Information is information that can be reasonably connected to an identified or identifiable individual. It does not include deidentified or anonymized data.

The purpose of this Privacy Policy is to disclose to you how we collect Personal Information on and off of our Sites, and how we use, disclose and attempt to safeguard the Personal Information we collect and process. We may update this Privacy Policy from time to time. When we do, we will post an amended version of the Privacy Policy on this website. Please review this Privacy Policy periodically.

3. WHY WE COLLECT INFORMATION AND HOW WE COLLECT IT


We collect, process, and use Personal Information to allow you to provide our products, Services and Sites to you. For example, we use the Personal Information we collect to:

  • Provide you with information, quotes, and offers (including use in our marketing and advertising efforts);

  • Connect you with our distributors and service partners;

We utilize commercially reasonable security measures to safeguard the information we collect, maintain, and use. However, please be aware that no security measures are perfect or impenetrable, and we cannot guarantee “perfect security.”

We do not intentionally target any consumers under the age of sixteen (16) years of age. We do not knowingly sell or share and have not knowingly sold or shared the Personal Information of individuals under the age of sixteen (16) years for monetary or other valuable consideration.

  • Social media information (such as your social media account names / handles and any direct message information you have with us);
  • Geolocation information (such as your zip code when you use our Where to Buy feature to locate one of our distributors);
  • Internet or other electronic network activity information (such as your browsing history, IP address, location, device type, date and time of visit, operating system, browser type and version, your activities on the Sites, information about how you use and interact with the Sites, mobile ad identifiers, and your mobile device’s unique device ID); and
  • Inferences drawn from above information (such as information regarding your preferences).

We use cookies and other tracking technologies (such as pixels and web beacons) (collectively, “cookies”) to collect information as you navigate the Sites. Cookies are small files of information that are stored by your web browser software on your computer hard drive, mobile, or other devices (e.g., smartphones or tablets).

8. INFORMATION WE OBTAIN FROM THIRD PARTIES

 

From time to time, we receive information about individuals from our third party service providers, affiliates, agents, social media services, distributors, and partners. For example, our distributors and service providers may provide Personal Information about you to us if they need the information to provide products or Services to you, such as quotes, orders, installation services, warranty information, services, or part replacements.


9. GLOBAL PRIVACY CONTROL

 

In addition, some browsers offer you the ability to opt out of the sharing of your Personal Information by turning on a Global Privacy Control. You can turn on a Global Privacy Control in your web browser or browser extension or by visiting https://globalprivacycontrol.org/. At this time, we endeavor to respond to browser-based opt-out signals sent through the Global Privacy Control.

We disclose Personal Information to various third parties to conduct our business, provide our products and Services, advertise our business, connect customers with a nearby distributor, and to comply with applicable laws. Further, we may disclose your Personal Information when you request or otherwise consent to the disclosures, as specified at the point of collection, or as otherwise set out in this Privacy Policy. For example, if you provide information through our Where to Buy form, we may disclose the information you provide with a Kolbe distributor.


11. SALE AND SHARING OF PERSONAL INFORMATION


Kolbe does not “sell” Personal Information, as that term is commonly interpreted. However, we do engage in targeted advertising activities that may constitute “selling” or “sharing” or using for “targeted advertising” under applicable U.S. state privacy laws.  Specifically, we use Google Ad Manager and other similar tools, which places tools on our Sites to collect information from our Site users so that Google may serve those users with targeted advertisements through other websites. To the extent this is considered “selling”, “sharing”, or “targeted advertising”, in the preceding 12 months, we have sold or shared the following categories of Personal Information for the purpose of showing you ads about our Services and products:

  • Internet or other similar network activity

To exercise the right to opt-out, you (or your authorized representative) may submit a request to us by clicking on the “Do Not Sell or Share My Personal Information” link below. You do not need to create an account with us to exercise your opt-out rights.

 

12. YOUR RIGHTS

 

We respect your privacy and provide you with the following options:

  1. You may opt out of marketing communications. You can always choose whether you wish to receive marketing communications we send via email, SMS messages, telephone calls, and postal mail. To unsubscribe from our marketing emails, please click the unsubscribe link included in the footer of our emails. You may also contact us through our online form or at privacy@kolbewindows.com to opt out of our marketing communications.

  2. You may control cookies used. You may opt out of cookies through your account settings in the Sites or as described in Section 7 above.

You may also have certain rights relating to your Personal Information subject to local data protection laws. Depending on the applicable laws and in certain circumstances, you may have the following rights:

RIGHT TO KNOW You have the right to request that we disclose to you the Personal Information we collected about you. This right includes the right to request: (1) specific pieces of Personal Information we have collected about you; (2) categories of Personal Information we have collected about you; (3) categories of sources from which the Personal Information was collected; (4) categories of third parties to whom your Personal Information was disclosed; and (5) the business or commercial purpose for collecting your Personal Information.
RIGHT TO REQUEST DELETION You have the right to request that we delete your Personal Information that we have collected from you, with some exceptions. Note that if you request that we delete your information, we may be unable to provide you with certain offers or services.
RIGHT TO CORRECT You have the right to correct inaccurate Personal Information we maintain about you.
RIGHT TO OPT OUT OF THE SALE AND SHARING OF YOUR PERSONAL INFORMATION The right to direct us not to sell or share personal information we have collected about you to third parties for targeted advertising.
RIGHT TO NON-DISCRIMINATON You have the right to non-discrimination for exercising your rights. This means we cannot deny you goods or services, charge you different prices, or provide a different level of quality of goods or services just because you exercise your rights.
“SHINE THE LIGHT” Civil Code Section 1798.83 permits you to request information regarding the disclosure of your Personal Information to a third party for the third party's direct marketing purposes.
 

13. EXERCISING YOUR RIGHTS

 

To exercise your rights described above, please submit a verifiable consumer request to Kolbe by:

Only you, or a person that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. If you are making a request on behalf of another person, you must provide written legal documentation that you are authorized to act on behalf of that individual. The verifiable consumer request must:

  • Provide sufficient information that allows Kolbe to reasonably verify you are the person about whom it collected Personal Information or an authorized representative; and
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We may not be able to fulfill your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. To verify your identity, we may request up to three pieces of Personal Information about you, and we reserve the right to take additional steps as necessary to verify your identity if we have reason to believe a request is fraudulent. If you do not agree with how we responded to your request, you may ask us to review our decision by contacting us through the above noted methods.

Kolbe endeavors to respond to a verifiable consumer request within 45 days of its receipt. If Kolbe requires more time (up to 90 days), it will inform you of the reason and extension period in writing. Kolbe will deliver the written response by mail or electronically, at your option. The response Kolbe provides will also explain the reasons it cannot comply with a request, if applicable. For data portability requests, Kolbe will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

 

14. SECURITY

 

When you register for an account with us, you may be required to choose or will be assigned a password which enables you to access our Sites. You are responsible for keeping this password confidential and for all activity that takes place through your account credentials. Do not share your password with anyone. If your password is compromised, change your password within your account. If you believe your account may have been compromised, please notify us immediately.

We take industry standard security measures to protect your information. We also have put into place appropriate agreements and/or procedures with our service providers to ensure that your Personal Information is treated consistent with applicable data privacy and security laws. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your Personal Information, we cannot and do not guarantee the security of your Personal Information.

   

Our Sites may contain links to other websites and companies that may be of interest to you. If you click on any of those links, you will leave our Sites. We are not responsible for third-party websites. Therefore, please consult the terms of service and privacy policies of those sites when you visit them.

 

16. RETENTION OF PERSONAL INFORMATION

 

We will store your Personal Information for as long as: (a) you maintain an account with us; (b) you continue using our Sites and Services; (c) in accordance with our retention policies and schedules; and (d) as long as we are legally required to retain the Personal Information.
